1. Purpose of Reports
Reports provided by the Company are analytical tools intended to assist property owners in evaluating property values, market activity, and potential property tax assessment considerations. Reports may include analysis, commentary, statistical summaries, and comparable property information.
Reports are intended for informational and analytical purposes only and should not be relied upon as a formal appraisal, broker price opinion, legal advice, tax advice, or investment advice.
The purchase of a report does not constitute the sale, transfer, or licensing of any underlying real estate databases or proprietary datasets.
2. Data Sources
Reports may incorporate data obtained from a variety of sources including, but not limited to:
- Public property records
- County appraisal district data
- Real estate market data providers
- Multiple Listing Services (MLS)
- Publicly available real estate transaction records
- Third-party data vendors
Such data is believed to be reliable but is not guaranteed to be accurate, complete, or current. The Company does not control the accuracy of data provided by third-party sources.
All data provided by third-party sources remains the property of the respective data providers and is used solely for the purpose of generating analytical reports.
3. No Warranty of Accuracy
While reasonable efforts are made to ensure the accuracy of information contained in reports, the Company makes no representations or warranties regarding the accuracy, completeness, reliability, or timeliness of any information contained in the reports.
Real estate data may contain errors, omissions, delayed updates, or inaccuracies. Users should independently verify any information before relying upon it for financial, legal, or real estate decisions.
4. Not an Appraisal
Reports generated by the Company are not real estate appraisals and should not be relied upon as certified valuations.
The Company is not acting as a licensed appraiser unless explicitly stated in writing. Any opinions of value expressed in reports are analytical interpretations of available market data and are not guaranteed representations of market value.
5. Limited Use License
Upon purchase, the Company grants the purchaser a limited, non-exclusive, non-transferable license to use the report for personal use related to evaluating their own property or working with authorized advisors.
Reports may be used by the purchaser for purposes such as:
- Evaluating property values
- Preparing for property tax discussions or appeals
- Informational real estate research
No ownership rights to any underlying data or software are transferred to the purchaser.
6. Restrictions on Use
You agree not to:
- Reproduce, distribute, publish, or resell reports or report contents
- Use reports to create competing products or databases
- Extract or compile data from reports to build derivative datasets
- Use reports for commercial redistribution or resale
- Misrepresent the source of any information contained in reports
Reports are provided exclusively for the use of the purchaser and may not be redistributed without prior written permission from the Company.
7. Third-Party Data and MLS Information
Certain real estate data included in reports may originate from third-party sources, including Multiple Listing Services (MLS). Such information is proprietary to the respective data providers and may be protected by copyright or licensing restrictions.
The Company does not claim ownership of MLS data or other third-party data sources. Such information is used solely for analytical and informational purposes within reports.
Users may not reproduce, distribute, or use MLS-derived information or other third-party data to create commercial datasets, databases, or products.
8. No Professional Advice
The information provided in reports is not intended to replace professional advice from licensed real estate professionals, appraisers, attorneys, tax advisors, or financial advisors.
Users are encouraged to consult appropriate professionals before making financial or legal decisions related to property ownership or tax matters.
9. Limitation of Liability
To the fullest extent permitted by law, the Company shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from the use of or reliance on any reports or information provided through the Services.
This includes, but is not limited to, loss of profits, financial loss, lost opportunities, or reliance on inaccurate or incomplete data.
10. Indemnification
You agree to indemnify and hold harmless the Company, its owners, employees, affiliates, and partners from any claims, damages, liabilities, or expenses arising from your use of the Services or violation of these Terms.
11. Intellectual Property
All website content, software, report formatting, analysis methods, and intellectual property developed by the Company are the exclusive property of the Company and may not be reproduced without permission.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to conflict of law principles.
Any disputes arising from the use of the Services shall be resolved in the state or federal courts located within Fort Bend County, Texas.
13. Modifications
The Company reserves the right to update or modify these Terms at any time without prior notice. Continued use of the Services after changes are posted constitutes acceptance of the revised Terms.
14. Client-Specific Reports
Reports generated by the Company are prepared for the specific property requested by the purchaser. Comparable properties referenced within reports are selected solely for the purpose of providing contextual market analysis related to the subject property.
Reports are not intended to function as a database of real estate transactions and should not be used to compile lists of comparable sales or real estate market datasets.
